Tennessee Real Estate Advertising Requirements

If you are a Dalton Wade agent licensed in Tennessee, your real estate advertising must comply with the advertising requirements established by the Tennessee Real Estate Commission (TREC).

These requirements apply to signs, social media, websites, business cards, flyers, postcards, digital advertisements, listing marketing, and other forms of real estate advertising.

Brokerage Name Requirements

Your advertising must identify your licensed real estate firm:

Dalton Wade Real Estate Group or Dalton Wade, Inc.

If your individual agent name, team name, or group name appears in an advertisement, Dalton Wade Real Estate Group must appear in letters that are the same size or larger than your name, team name, or group name.

For example, if your name appears in 24-point font, Dalton Wade Real Estate Group should appear in at least 24-point font.

Avoid displaying your individual or team name prominently while placing the Dalton Wade Real Estate Group name in significantly smaller text.

Brokerage Phone Number

Tennessee advertising requirements generally require the firm telephone number on file with the Tennessee Real Estate Commission to appear in advertising.

Your personal telephone number may also be included, but it does not replace the required firm telephone number.

Be sure to use the current Dalton Wade Tennessee firm telephone number when creating your advertising.

Your Name

If your name appears in an advertisement, use your name as it appears on your Tennessee real estate license/TREC record.

Social Media Advertising

Tennessee's advertising requirements also apply to social media, including platforms such as Facebook, Instagram, LinkedIn, TikTok, and similar platforms.

For social media advertising, Tennessee allows the required firm name and firm telephone number to be no more than one click away from the viewable page.

For example, the required brokerage information may be available through your social media profile when it is readily accessible from your post.

Whenever possible, including your brokerage information directly in your real estate marketing posts can also help make your brokerage affiliation clear.

Advertising a Property

Before advertising a property for sale, purchase, exchange, rent, or lease, you must have the appropriate authorization from the property owner or the owner's authorized agent.

This includes placing a real estate sign on the property.

Advertising Another Agent's Listing

Do not advertise a property listed by another real estate licensee unless the required written authorization from the property owner has been obtained.

Authorization may be included within the listing agreement or another written statement signed by the property owner.

Your MLS or REALTOR® association may have additional rules regarding advertising another agent's listing. You are responsible for following those requirements as well.

Signs

Real estate signs are considered advertising and must comply with Tennessee advertising requirements.

In addition to TREC requirements, signs may be subject to:

  • MLS requirements
  • REALTOR® association requirements
  • Local sign ordinances
  • HOA or condominium restrictions
  • Property-specific restrictions

Always confirm that you have authorization before installing a sign on a property.

Business Cards, Flyers & Other Print Marketing

Business cards, postcards, flyers, brochures, mailers, and other print marketing are considered advertising.

Remember that if your agent or team/group name appears on the material:

Dalton Wade Real Estate Group must appear in lettering that is the same size or larger than your agent/team/group name.

The required Dalton Wade firm telephone number should also be included.

Websites & Digital Advertising

Agent websites, landing pages, online advertisements, email marketing, and other digital marketing are also subject to Tennessee advertising requirements.

Your affiliation with Dalton Wade Real Estate Group should be clearly identified.

These requirements still apply when your advertising is created by a third-party marketing company, website provider, lead provider, graphic designer, or other vendor.

Keep Your Advertising Accurate

All real estate advertising should be truthful, accurate, and current.

Before publishing an advertisement, verify information such as:

  • Listing price
  • Property status
  • Property features
  • Availability
  • Brokerage affiliation
  • Your contact and license information
  • Claims regarding your services, experience, production, or results

Update or remove advertising when information is no longer accurate.

Before You Publish: Quick Checklist

  • Dalton Wade Real Estate Group is identified.
  • Dalton Wade Real Estate Group is the same size or larger than my agent/team/group name when applicable.
  • The appropriate Dalton Wade Tennessee firm telephone number is included.
  • My name is displayed correctly and matches my licensed name.
  • All property information is accurate and current.
  • I have authorization to advertise the property.
  • If advertising another agent's listing, I have confirmed the appropriate authorization and MLS requirements.
  • My social media profile contains the required brokerage information when relying on Tennessee's one-click provision.
  • My advertisement does not contain anything false, deceptive, or misleading.
