Business Card Design - Compliance by State

General Rule Across All States
Every business card must include the brokerage name: Dalton Wade Real Estate Group or Dalton Wade, Inc. It must be clear, conspicuous, and in compliance with state advertising laws.

Alabama - Source

  • Alabama Code Section 34-27-36(a)(15) requires that advertisements prominently identify the trade name of either the company or the qualifying broker for whom the licensee making the advertisement works.

  • Alabama Code Section 34-27-36(a)(6) requires that any advertisement also “identify the person causing the advertisement to be placed as a licensed broker or salesperson.” In other words, any person who views the advertisement should be able to easily identify that it is an advertisement for brokerage services.

Georgia - Source

  • Is Not Misleading or Inaccurate
  • Does Not Discriminate
  • In the Name of the Broker (Firm not the person)
    • Corporate Name or Trade Name as approved by GREC
    • In a manner reasonably calculated to attract the attention of the public
  • Reviewed & Approved by the Broker
  • Must assure Public they are being contacted by a licensed real estate agent

North Carolina - Source

  • All advertisements must clearly display the name of the brokerage firm with which the broker is affiliated.

  • Brokers should use their legal names in advertisements. Nicknames are permissible if they are commonly associated with the legal name and do not cause confusion. For example, using “Bill” for “William” is acceptable.

Texas - Source

  • TREC Rule §535.155 Advertisements - All license holders’ advertisements must include the license holder’s name or team name. It also must include the broker’s name in at least half the size of the largest contact information for any sales agent, associated broker, or team name contained in the advertisement.
  • TREC Rule §535.154 Registration and Use of Names - This rule defines an alternate name, associated broker, assumed business name and team name. Each type of name must be registered with TREC before the name can be used in an advertisement.

Tennessee - Source

  • The firm name must appear in letters the same size or larger than those spelling out the name of a licensee or the name of any team, group or similar entity.

  • Must list the individual licensee's name as licensed with the Commission.

Florida - Source

  • The licensed name of the brokerage firm is the full name that firm is registered under the Department of Business and Professional Regulation (DBPR).

  • The agent’s last name must appear as it is registered with the Florida Real Estate Commission.

Tip: If you work in multiple states, design one card that meets the strictest requirement so you don’t need multiple versions.
