Lead Based Paint Disclosure



For homes built before 1978, a Lead Based Paint Disclosure is required per Federal law.  The year built can be found on the Public Record (effective year) or on the MLS Broker Synopsis under “Year Built”.

Listing Agent:

Please ensure you add this important addendum to your folder and send to the seller(s) for signature.  Federal law states when we are being paid a commission by the seller, it is our job to help ensure the seller is in compliance.  Fines for failure to comply with this Federal law could be triple criminal and civil damages.  We want to ensure we comply with this law 100% of the time. 

To add the Lead Based Paint Disclosure:

-Click on “ADD DOCUMENT” to the right of the Listing Docs loop
-Click on “
TEMPLATES
-Scroll to “
LEAD BASED PAINT


-Click “COPY” – the disclosure will be added to your folder.
-You can autofill and send for signature & initials.
  Note:  As the Listing Agent you also need to initial and sign in the Listing Agent fields.
-Once signed you can upload to your MLS listing as an attachment.

VERY IMPORTANT: the seller must sign this document first prior to the buyer signing!

 

Buyer Agent:

If the listing agent did not upload the Lead Based Paint Disclosure as an attachment in MLS, reach out and ask for a copy. Keep your buyer informed and let the listing agent know it is required per Federal law and you will have the buyer ratify as soon as it is provided.  The seller must sign this disclosure prior to the buyer signing!

You can add the Lead Based Paint Disclosure to your loop and send to the listing agent for the seller & listing agent to initial & sign and return to you.  Please ensure you add the “Lead Info Pamphlet” to your loop as well for your buyer(s) to initial. This should be sent to clients who are purchasing a home that was built prior to 1978 and has a Lead Based Paint Disclosure.

You can add both as follows:

-Click on "ADD DOCUMENT" to the right of the folder

-Scroll to "

-Place a check in the box next to “
Lead Based Paint Disclosure” & “Lead Info Pamphlet


-Click “COPY” – both documents will be added to your folder.

-Once signed copy of the “Lead Based Paint Disclosure” is received, you will add the signature & initial boxes to the disclosure for your buyer(s) to initial & sign as well as the “Lead Info Pamphlet” for initials.  See “Adding Signature & Initial Fields Manually” for assistance.
-You will also need to sign the “Lead Based Paint Disclosure” in the Selling Agent field. 
-Return signed copy of the “Lead Based Paint Disclosure” to buyer(s), title company and lender (if applicable).
-The initialed “Lead Info Pamphlet” will stay in the folder.

 

Please Note: there are a few exemptions to this law:

Exemption 1: Housing for Older Persons (55+), where there is no expectation of a child six or under living in the residence..

Exemption 2: Bank Owned Property. 

If either of these exceptions apply, please let the buyer(s) know and provide them with the “Lead Info Pamphlet”.
