Agent Selling/Buying Their Own Property

When a licensed agent is involved in the sale or purchase of a property in which they have an ownership interest, full disclosure is required.

This applies when:

  • You are selling your own property

  • You are purchasing a property for yourself

  • The transaction involves an immediate family member

  • The transaction involves an entity in which you have ownership


Disclosure Requirements

Agents must:

  • Disclose their ownership interest in writing to all parties

  • Provide this disclosure prior to contract execution

  • Clearly communicate their role in the transaction

This requirement is based on the REALTOR® Code of Ethics (Article 4, Standard of Practice 4-1) and applies across all states.

Depending on your role in the transaction, you may also consider using a No Brokerage Relationship Disclosure where appropriate.


Required File Submission (Dotloop)

All transactions involving your own property must be submitted through Dotloop.

Dalton Wade is required to maintain transaction records per state regulations.
The Dalton Wade transaction fee applies to all transactions, including those involving your own property.


Setting Up Your Loop

  1. Click “Add Loop”

  2. Enter the property address or import from the MLS

  3. Select the appropriate template:

    • Listing for Sale

    • Residential Purchase

    • New Construction (if applicable)

  4. Click “View Loop”


Listing Your Own Property

The Listing Docs folder will automatically populate.

Required Documents:

  • Listing Agreement

    • Must be signed by you as both seller and listing agent

    • Share with your broker for required review/initials

  • Licensee Disclosure of Personal Interest (Required)

  • Exemption Request Form (in place of Owner Authorization)

  • Applicable Addenda:

    • HOA / Condo Rider

    • Lead-Based Paint Disclosure (if applicable)

    • CDD / community disclosures

    • Any other required state/local forms

  • Brokerage Disclosures (as applicable if representing another party):

    • Wire Fraud Prevention Notice

    • Affiliated Business Arrangement (ABA) Disclosure

Note: Agents selling their own property may be exempt from certain brokerage forms when acting solely as the owner.


When Your Property Goes Under Contract

Upload the following to the Initial Docs (Contract) Folder:

  • Executed Contract

  • Licensee Disclosure of Personal Interest (signed)

  • All applicable addenda

If you are also representing the buyer, you must include:

  • Buyer Disclosure

  • Wire Fraud Prevention Notice

  • Energy Efficiency Brochure (if required)

  • ABA Disclosure

Important:
You cannot act as a neutral or transaction broker for a buyer when you are the property owner.


Mid-Transaction (CDA & Earnest Money)

Required Items:

  • Earnest Money Deposit (EMD) Receipt from title

  • Commission Disbursement Authorization (CDA)

CDA Guidelines:

  • Dalton Wade fee must be included and payable to Dalton Wade

  • If waiving commission:

    • Include amount in the Commission Detail section

    • Upload signed Commission Rebate/Waiver Authorization Form (broker approval required)

  • If charging a transaction fee to the buyer:

    • Include it in the CDA under “Transaction Fee”

Note:
If compensation is listed as $0 when selling your own property, the waiver form may not be required.


Closing Documents

Upload to the Closing Docs Folder:

  • Final Signed ALTA / Settlement Statement

  • Final Walk-Through (strongly recommended for documentation purposes)
